TERMS & CONDITIONS
REQUEST FOR COUNSELLING SERVICES

The following are the Terms and Conditions (‘T&Cs’) which govern your use of services provided to you by Navigating Aviation Pty Limited ACN 676 805 173 (‘we’, ‘our’, ‘us’). In these T&Cs, Navigating Aviation Pty Limited (or we, our, us) means Navigating Aviation Pty Limited and its directors, officers, employees, contractors, subsidiaries and related companies.   By using our services, including online and face to face counselling services, you agree to comply with and to be bound by these T&Cs.

  1. We provide various mental health support services to participants in the aviation industry.
     

  2. Services are provided at the request of our corporate clients which include companies who employ, contract with, provide training to our otherwise interact with personnel in the aviation industry.
     

  3. The precise services to be provided to you will depend on the arrangements with the corporate client who has engaged us on your behalf as well as the availability of our personnel, your availability and the nature of your specific requirements. 
     

  4. We will endeavour to provide you with services that are useful to you in accordance with our arrangements with the corporate client who has engaged us but we do not guarantee that any particular kind of service will be available at any particular time, will be suitable for your particular needs or will be provided to you.  
     

  5. We request that if you need to reschedule or cancel a booked session you [notify us by email hello@navigatingaviation.com] as early as possible. A session can be rescheduled once without charge to our corporate client if more than 48 hours’ notice is provided. 
     

  6. You understand, agree, and acknowledge that any provided or facilitated by us may not be the appropriate solution for your needs and is not a substitute for obtaining your own healthcare via other care and treatment solutions available through other providers.
     

  7. In using our services, you warrant that you are over 18 years of age and that you have provided correct, truthful and accurate information to us when completing our booking processes. 
     

  8. Our services are not acute or emergency services.  In the case of an emergency please contact the public emergency services by dialling 000 by telephone. 
     

  9. You acknowledge that in providing any service to you, we will need to collect and record your personal information. Your information will be recorded and stored in accordance with our Privacy Policy.
     

  10. We take your confidentiality seriously and we will not disclose your personal information except in accordance with our Privacy Policy.  It is important for you to understand that there are some occasions when we are required to disclose your personal information which may include matters disclosed to us on a confidential basis, including where the matters give rise to a reasonable apprehension of imminent physical harm to any person, including You or a serious threat to public health or public safety.
     

  11. The Australian Consumer Law provides for certain warranties and guarantees which cannot be excluded, restricted or modified (Non-Excludable Term).  Nothing in these T&Cs excludes, restricts or modifies a Non-Excludable Term.   
     

  12. To the extent permitted by law, our liability for any loss or damage arising from a Non-Excludable Term is limited to resupplying the services or to the payment of the cost of having the services supplied again and otherwise will be limited to the maximum extent permitted by law.
     

  13. Subject to clause 11 above, we are not liable to you for any loss, liability, damage or claim arising from, caused by or in relation to any service provided by us, and for the avoidance of doubt are not liable for any indirect, incidental or consequential loss, damage, expense or cost, loss of profits or revenue, business interruption, loss of data or anticipated benefits arising in any way out of the provision or non-provision of services by us.
     

  14. All content provided by us remains our intellectual property and may not be reproduced, used, forwarded, sold, distributed or disseminated without our consent.  
     

  15. These T&Cs are governed by the law of New South Wales and in the event of any legal action, you submit to the exclusive jurisdiction of the courts of New South Wales at Sydney. 
     

  16. These T&Cs constitute the entire agreement between you and us. You may not rely upon any promises or representations by us except as set forth in this agreement. 
     

  17. If any provision of these T&Cs is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of these T&Cs which will continue in full force and effect.
