Navigating Aviation Pty Ltd ACN 676 805 173 (‘we/us/our’) is committed to ensuring that personal information provided to us is handled in accordance with the Privacy Act 1988 (Cth) and other relevant legislation.  We respect the privacy of the personal information you may provide to us.

Collection of Personal Information

The personal information we will collect will depend on how you interact with us.

We collect personal information from employees, personnel and contractors of our corporate clients and potential clients, those undergoing training with or providing services to our corporate clients, our employees, contractors and potential employees and contractors, our suppliers, employees or contractors of Government agencies and other persons and entitles to enable us to conduct our business.  We also collect information from people when we provide counselling or other services to them and collect information from those who interact with our website.  

The personal information we collect may include:

  1. information about you including your name, address, contact information, date of birth, country of residence, address, employment or financial information;

  2. information you have disclosed to us whilst using our services including information regarding physical or mental health conditions, your medical history, your employment status and history and personal and social interactions;

  3. information your employer has disclosed to us to allow us to provide services to you including information relevant to your employment history and incidents occurring during your employment;

  4. records of your communications and interactions with us;

  5. information regarding incidents or feedback provided to us including details about incidents you have been involved in or witnessed, claims you have made, or feedback provided by others that relates to you;

  6. information recorded by us or a third party provider when you visit our website or use our mobile applications including the IP address used to access the site, the date and time accessed, your operating system, the pages you accessed and information collected via cookies or web logs; and information provided in connection with an enquiry about working with us or providing us with services or information that relates to an arrangement to provide us with services.

In most circumstances personal information will be collected directly from you where you provide the information to us in person, via online meetings, by telephone, email, in writing or via online systems such as our website. For instance, you provide us with information when you complete intake forms and when you provide us with information during in person or online/phone counselling sessions.

In some circumstances information about you may be provided by third parties, such as your employer. 

 

By providing personal information to us or allowing someone else to provide the information on your behalf, you consent to us collecting and using the information in accordance with this Privacy Policy.

We may also collect information which is considered sensitive information including information about your past or present physical or mental health conditions, information about your racial or ethnic origin, political opinions or associations, religious or philosophical beliefs, sexual orientation or criminal record (‘Sensitive Information’) where you provide us with that information during the course of us providing you with counselling or other services.   By providing Sensitive Information to us or allowing someone else to provide Sensitive Information to us on your behalf, you consent to us collecting the Sensitive Information and storing and using that information in accordance with this Privacy Policy.  The collection of Sensitive Information is reasonably necessary and directly related to our function in providing counselling and other services to individuals.

Where you are our employee and personal information provided to us is an employee record within the meaning of the Privacy Act 1988 (Cth), this Privacy Policy will not apply to that information.

If you do not wish to provide us with personal information, we will provide you with the option to deal with us anonymously or using a pseudonym, but we may not be able to provide you with some or all of our services or progress any application for employment.

Use of personal information

Personal information collected or held by us will be used:

  1. to provide and manage services we provide to you including counselling and other mental health services;

  2. to communicate with you;

  3. to provide and manage services we provide to your employer and to communicate with your employer regarding the provision of services to you and your employer;

  4. to analyse and improve the services we provide to you, your employer or others; and

  5. for any other lawful purpose.

Storage and Security of personal information

We will store your personal information using electronic formats.  We use third party providers to store electronic information.  Some electronic information is stored outside Australia.  We will take reasonable steps to ensure that your personal information is stored securely and is protected from misuse and loss and from unauthorised access, modification, or disclosure.

If you become aware of any breach of our electronic security systems please alert us to this as soon as possible.

Disclosure of personal information

In the general course of our business, we share personal information with our professional advisors, insurers, contractors, suppliers, service providers and clients.

We may also disclose your personal information as follows:

  1. to your employer, for the purpose of providing information regarding the services we are providing; 

  2. to Government or regulatory authorities including international government or regulatory authorities, Courts and other statutory bodies;

  3. where it is necessary to lessen or prevent a serious threat to life, health or safety or public health or safety;

  4. to defend, establish or in relation to a legal claim;

  5. where there is a statutory requirement to share the information;

  6. other organisations that perform services on our behalf.

Other than in the course of providing you with services or as otherwise described in this Privacy Policy, we will not share personal information with a third party without your consent.

Keeping, Accessing and Accuracy of Personal Information

You have the right to access your personal information that is held by us and if the information is incorrect to request that we correct the information.

Complaints

We take complaints regarding privacy very seriously. If you have a complaint about the way your personal information has been or is being managed by us or have a question regarding privacy you can contact the Privacy Officer using the details in section 5 above.  We will respond to your complaint within 30 days.  If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner at:
